Define liability, insurance and incident evidence

Freight liability should be agreed before something goes wrong. Customer contracts, carrier terms and insurance policies may allocate different duties, exclusions and limits. Cargo insurance, vehicle insurance and your operational responsibilities are not interchangeable. Ask qualified legal and insurance advisers to review the actual arrangement. The practical operating goal is to know whom to notify, how to protect people and goods and how to retain trustworthy evidence without making unsupported promises about reimbursement.

Your learning goals

What you’ll learn

  • Separate customer, carrier and insurer responsibilities.
  • Prepare a notification and evidence routine.
  • Keep claims distinct from physical custody and accounting closure.

Useful terms

Claim
A request for compensation supported by facts and applicable terms.
Declared value
A stated value used for agreed commercial or risk purposes; it is not automatically insured value.

Step-by-step operating routine

  1. Review the commercial responsibility map

Identify the contracting customer, actual carrier, broker and custodian at each stage. Agree service commitments, exclusions, evidence requirements and dispute contacts. Do not assume all parties share the same liability terms. Review applicable statutory carrier liability and required goods declarations with your legal adviser; private terms should not be assumed to override mandatory duties.

    • Dispute contact
  2. Review insurance fit

With an adviser, check policy holder, insured interest, goods, routes, limits, exclusions and notification requirements. Keep certificates and policy wording available to authorised staff. Do not interpret a premium receipt as complete coverage.

  3. Prepare the incident process

Define immediate safety actions, authorised contacts and evidence collection. Staff should record observed facts, quantities and condition without assigning blame or admitting liability beyond their authority.

  4. Preserve the goods and timeline

Record the responsible location, affected packages, photos where safe, witness details and external references. Follow authorised handling instructions. Maintain a correction history instead of replacing the original observation.

    • Package IDs
    • Quantity
    • Condition
    • Location
    • Timeline
  5. Resolve and account separately

Track assessment, agreed settlement, credit or recovery and payment. Release or dispose of goods only under authorised instructions and applicable requirements. A claim settlement must not falsely mark held freight delivered.

    • Claim state
    • Decision evidence

Worked example

Damage with goods still in custody

Five cartons arrive wet at a branch. The team isolates them safely, records their labels and condition, alerts the responsible parties and awaits instructions. A later agreed credit resolves part of the financial dispute. The cartons still require a documented delivery, return or authorised disposal decision.

  • Retain physical custody while the claim is open.
  • Use factual evidence and authorised communications.
  • Keep financial and goods disposition records separate.

Exceptions and mistakes to avoid

  • Never tell a customer that every loss is insured without checking the policy.
  • A driver should not sign a liability admission beyond their authority.
  • Do not destroy damaged packaging or evidence before the authorised investigation process permits it.

Check your understanding

Try answering first, then open the explanation. Use the worksheet and source records to practise the task.

Does an insurance certificate prove the particular goods are covered?

No. Review policy scope, exclusions, limits, conditions and the actual shipment with the insurer or adviser.

Can a credit note close physical custody?

No. The goods still require a valid delivery, return or other authorised disposition.
